Do My Bills Need to be Current to File Bankruptcy?

No.  Often times, debt collectors tell you on the phone that you cannot file bankruptcy until you pay them to get current.  Don't listen to them.  These people are not working for you, Think about it, they are the people you owe money to.  Of course they are going to advise you against filing bankruptcy.  That means they don't get paid.

Another question we get a lot is how far behind you need to be to file bankruptcy.  You need to be in debt to consider bankruptcy, but where you are in your payment cycle doesn't matter much.  If you are filing Chapter 13 to catch up on payments, it is important to file your case before you lose your property to a foreclosure or repossession

If you are at the point of getting debt collection calls, it is probably best to speak to an attorney sooner rather than later.  To schedule a free consultation , call us at 631-289-4600 today.  We will go over your individual situation and discuss what options are best for you.
