If your Chapter 13 bankruptcy confirmation has been denied, there are several things you can do to you to increase your chances of a positive outcome at the next hearing. If the reason confirmation was denied was you payment plan, you may amend it to adjust your payment or the treatment of a creditor. You may also amend the schedules if your income and expense scheduled do not show adequate income to pay your payment. A very common barrier to confirmation is objections from debtors. Many times certain creditors want special treatment or payment in your plan and you will need to resolve these objections. Trustee objections are also common obstacles to overcome in the confirmation of your plan. You will usually have a preconfirmation hearing with the trustee in which you will have the opportunity to resolve objections. After doing all this, if confirming your Chapter 13 plan is not possible, you may decide to convert to a Chapter 7 case if you qualify.
