What are the Current Credit Counseling Requirements in Bankruptcy?

Bankruptcy Law One of the requirements of the bankruptcy law that went into effect in 2005 is that all individual debtors filing a bankruptcy case must complete a credit-counseling course by a certified company within six months prior to filing their case. If for some reason, you aren't able to file bankruptcy 6 months after taking the course, you must take it again prior to filing. The course itself takes about an hour and most counseling agencies allow you to complete the course online with a short phone interview at the end. Congress also requires debtors to take another course AFTER the bankruptcy case is filed. This is a prerequisite to obtaining a discharge of debts. The debt management course takes a similar amount of time as the credit counseling course to complete and can also be done online.
